Welcome to Comfy Works. These Terms of Service govern your use of the Comfy Works website and your purchase of products from us.

By accessing or using our website, placing an order, or purchasing products from Comfy Works, you agree to these Terms of Service.

Please read these terms carefully before using our website or placing an order.

1. About Comfy Works

Comfy Works is a New Zealand bedding and home textile business supplying quality bedding products to customers in New Zealand.

In these Terms of Service, “Comfy Works”, “we”, “us” or “our” means Comfy Works.

All products are subject to availability.

We may limit quantities available for purchase or discontinue products at any time.

If a product becomes unavailable after you place an order, we will contact you and may offer:

  • An alternative product;

  • A later delivery;

  • A refund; or

  • Another appropriate solution.

5. Prices

All prices displayed on our website are in New Zealand Dollars (NZD) unless otherwise stated.

Prices include GST where applicable.

We reserve the right to change prices at any time. However, once an order has been accepted and confirmed, the price applicable to that order will generally remain unchanged except where an obvious pricing error has occurred.

Promotional pricing may be available for a limited time and may be subject to additional terms.

6. Orders

When you place an order through our website, you are making an offer to purchase the selected products.

An order confirmation email confirms that we have received your order. It does not necessarily mean that the order has been finally accepted.

We reserve the right to refuse or cancel an order where there is a reasonable basis to do so, including:

  • The product is unavailable.

  • There is an obvious pricing or product description error.

  • We suspect fraudulent or unauthorised activity.

  • We are unable to process the payment.

  • The order contains unusual or excessive quantities.

  • There is an error in delivery information.

If we cancel an order after payment has been received, we will arrange an appropriate refund.

7. Payment

Payment must be made using the payment methods available at checkout.

By submitting payment details, you confirm that you are authorised to use the selected payment method.

Payment providers may have their own terms and conditions and privacy policies.

Comfy Works does not normally have access to your complete payment card details.

8. Delivery

We aim to dispatch orders within the timeframe stated on our website or communicated to you.

Delivery times are estimates and may be affected by:

  • Courier delays

  • Weather

  • Public holidays

  • High-volume periods

  • Incorrect or incomplete delivery information

  • Events outside our reasonable control

Once your order has been dispatched, tracking information may be provided where available.

Please ensure that the delivery address supplied at checkout is accurate.

We are not responsible for delays resulting from incorrect delivery information supplied by the customer.

9. Click & Collect / Local Pickup

Where local pickup is offered, customers will be notified when their order is ready for collection.

Customers may be required to provide proof of purchase or identification when collecting an order.

Orders should be collected within a reasonable period after notification.

10. Returns, Refunds and Exchanges

Returns, refunds and exchanges are governed by our Returns, Refunds & 5-Year Warranty Policy.

Our returns policy does not limit any rights you may have under applicable New Zealand consumer law.

For faulty, damaged or incorrectly supplied products, please contact us as soon as reasonably possible.

11. 5-Year Limited Warranty

Selected Comfy Works products are covered by a 5-Year Limited Warranty, subject to the applicable product warranty terms.

The warranty generally covers manufacturing and material defects under normal and reasonable use.

The warranty does not generally cover normal wear and tear, accidental damage, misuse, improper care, staining, physical damage or other excluded circumstances.

The warranty is provided in addition to, and does not replace, any rights available under New Zealand consumer law.

12. Promotions and Discount Codes

Promotional offers and discount codes may be subject to specific conditions.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash.

  • Only one discount code may be used per order.

  • Discount codes may have expiry dates.

  • Some products may be excluded from promotions.

  • Promotions cannot generally be applied retrospectively to previous orders.

We reserve the right to withdraw or amend a promotion where necessary.

13. Intellectual Property

All content on the Comfy Works website, including:

  • Logos

  • Brand names

  • Product names

  • Product photographs

  • Graphics

  • Product descriptions

  • Website design

  • Text

  • Marketing materials

is owned by or licensed to Comfy Works and is protected by applicable intellectual property laws.

You must not reproduce, modify, copy, distribute, publish or commercially use our content without our prior written permission.

14. User Reviews and Submitted Content

If you submit a review, photograph, testimonial, comment or other content to Comfy Works, you confirm that:

  • The content is your own or you have permission to use it.

  • The content does not infringe another person's rights.

  • The content is not unlawful, misleading, defamatory or offensive.

By submitting content, you grant Comfy Works permission to use, reproduce and display that content for legitimate business and marketing purposes, subject to applicable law.

To the maximum extent permitted by law, Comfy Works will not be responsible for indirect, incidental or consequential loss arising from the use of our website or products.

Nothing in these Terms of Service excludes, restricts or limits any liability or consumer rights that cannot legally be excluded under New Zealand law.

Where applicable, the Consumer Guarantees Act 1993, Fair Trading Act 1986 and other relevant New Zealand legislation will continue to apply.

18. Consumer Guarantees Act

If you are purchasing products as a consumer, nothing in these Terms of Service is intended to exclude or restrict your rights under the Consumer Guarantees Act 1993.

Where a product does not meet the guarantees required by New Zealand law, you may have rights to a repair, replacement, refund or another remedy depending on the circumstances.

Our policies are intended to operate alongside, and not replace, your statutory rights.

We collect and use personal information in accordance with our Privacy Policy.
